Terms and Conditions of Sale – Cors’Aventure

I. Teaching and supervision services

Registration for supervised services from Cors’Aventure implies the pure and simple acceptance of these general conditions by the subscriber, who undertakes to inform each of the participants of all the modalities.

ART. 1 – INTERVENANTS

Cors’Aventure offers the supervision and teaching of outdoor sports disciplines: canyoning, sea kayaking, sailing, paddleboarding, rafting, whitewater kayaking, mountain biking, and hiking. All activities offered are supervised and insured by state-certified guides (BEES / DEJEPS) in their respective disciplines and meeting their legislative obligations (URSSA, RC, DDCSSPP declaration, professional cards).

ART. 2 – REGISTRATION AND BOOKING

All our activities are by reservation. To do this, you have several solutions: by filling out the online reservation form (www.corse-aventure.com) or by contacting Cors’Aventure directly by email (info@corse-aventure.com), phone (04-95-25-91-19 / 06-72-03-49-22), or at the reception of our base at Eccica-Suarella.

GROUP ACTIVITIES: Registration is effective when the subscriber receives a confirmation email for the chosen activity.

PRIVATE EVENTS (institutions, companies, associations): Registration is effective upon receipt of a deposit corresponding to 30% of the total cost of the service and a confirmation email for the chosen activity.

In both cases, the balance will be paid directly to the professional in his own name, at the beginning of the activity.

ART. 3 – PRICE

Cors’Aventure’s rates are presented on the website and in the brochure available for free at hotels, campsites, tourist offices, etc.

The prices include: organization, supervision by a state-certified guide and the loan of technical and safety equipment necessary for the practice of the chosen activity (5mm full-length wetsuit, neoprene socks, helmet, harness, paddle, vests, etc.).

Some products include the possibility of equipment rental, upon request (e.g. canyoning shoes, etc.).

In all cases, we invite you to refer to the product’s technical sheet, available on our website or upon request.

The prices do not include: the possible rental of equipment (e.g. Go Pro, laptop), transportation to the activity location (meeting place and practice site) and personal expenses.

For day trips, meals (picnic, water, snacks) are at the customer’s expense, unless otherwise stated.

ART. 4 – PAIEMENT METHODE

For supervision services, payment must be sent (in the form of a check or money order), directly to Cors’Aventure. This mention will be specified when booking.

Accepted payment methods: check, holiday voucher, bank transfer, credit card (secure online payment) or cash.

ART. 5 – PARTICIPATION CONDITIONS

Our activities are open to everyone; however, depending on the activities and the routes, certain conditions must be taken into account (age limit, knowing how to swim, technical level, physical condition, etc.).

Cors’Aventure does not have the means to verify the sports practice level of its customers.

It is therefore up to each participant to have assessed their physical condition in accordance with the choices of routes they wish to take. To find out about these conditions, please refer to the technical sheets of the routes (available on our website www.corse-aventure.com).

For canyoning and whitewater activities, it is imperative to know how to swim and immerse yourself.

You should not have any medical contraindications to the practice of the chosen activity.

IMPORTANT: If you do not have any medical contraindications, but you are dependent on special medical care or treatment (asthma, diabetes, etc.) or your health condition requires special attention (fragile joints, back problems, mandatory glasses, etc.), you must inform the instructor before the start of the activity and provide the appropriate emergency medications, according to medical recommendations.

ART. 6 – INSURANCE AND LIABILITY

Cors’aventure is insured in Professional Civil Liability for its own activities and for the costs incurred by a possible rescue operation.

We strongly advise each participant to be covered by a liability insurance and/or an individual accident insurance with the insurance of their choice for the practice of whitewater sports and/or mountain sports. Indeed, we cannot replace the individual civil liability of each participant.

Cors’aventure SARL is insured in civil liability for all activities it offers and its liability cannot be engaged for activities booked with other providers.

In case of bodily injury, the liability of the SARL Cors’aventure and the intervening instructor is released as soon as the victim is taken care of by the competent rescue organizations, and any hospital follow-up will be the responsibility of the personal insurances of the injured person.

The practice of outdoor activities takes place in a specific environment called “risky”.

Each participant is aware, given the specific nature of the activities offered, that they may be exposed to certain risks due in particular to the remoteness, isolation and the specific nature of the environment (river, cave, cliff, etc.). He assumes them with full knowledge of the facts and he must comply with the rules of caution and follow the advice given by professionals.

The participant/client is responsible for the equipment that has been lent to them for the activity. The professional cannot be held responsible for any damages that may be caused by the equipment provided.

In case of theft or damage to the loaned equipment, the participant/client may be asked for compensation for wear and tear or a full refund of the equipment.

The professionals (instructors) and SARL Cors’Aventure cannot be held liable for the loss, theft (including in vehicles) or breakage of objects (e.g. glasses, cameras, etc.) that the participants may bring with them during the activity and that may occur during the activity.

ART. 7 – CLIENT CANCELLATION OR INTERRUPTION FOR DAY ACTIVITIES

7.1 Cancellation by the customer

– Cancellation of a reservation up to 48 hours before the activity: full refund of the deposit

– Cancellation of a reservation less than 48 hours before the activity: the balance will be due

In case of force majeure and upon presentation of a supporting document, Cors’Aventure may refund the amount paid, but cannot be claimed by the customer. In all cases, the customer agrees to notify Cors’Aventure of all notifications relating to the reservation: program organization, change in staff, delay or cancellation.

7.2 – interruption during the service

In case of an interruption during the service, the customer or participant will not be entitled to any refund.

ART. 7A – CLIENT CANCELLATION OR INTERRUPTION FOR STAYS

7.1 Cancellation by the customer

– up to 30 days before departure: full refund (deposits and total balance).

– between 30 and 15 days before departure: 30% of the deposit will be withheld, the balance will be fully refunded.

– between 15 and 8 days before departure: 50% of the total price will be withheld.

– between 8 and 2 days before departure: 75% of the total price will be withheld.

– 2 days before departure: 100% of the stay price will be withheld.

ART. 8 – CANCELLATION / EXCLUSION BY CORS’AVENTURE

8.1 – Cancellation

The instructors of Cors’Aventure reserve the right to cancel or adapt the outing depending on the weather conditions or the level of the participants.

The activity may be cancelled for safety reasons (weather, EDF water releases, floods, etc.) or for any other force majeure. In this case, a replacement activity will be organized as far as possible or another date will be offered to you. If the activity cannot be carried out, the service will be fully refunded without being able to claim any other compensation.

In the event of a cancellation by us due to an insufficient number of participants (less than 4 people), the registered participants will be fully reimbursed and will not be able to claim any compensation.

8.2 – Exclusion

The instructors of Cors’Aventure reserve the right to exclude a participant who is intoxicated or whose behavior is likely to disrupt the smooth running of the activity or to compromise the safety of the group. In this case, the client or participant will not be entitled to any refund or compensation.

ART. 9 – MEETING

An appointment time and location will always be communicated to you, regardless of the service. For the smooth running of the activities and out of respect for the other participants and the professional who is guiding you, we kindly ask you to read the route sheets and other instructions that have been previously sent to you by us. Please plan your travel in advance so that you can be on time. We allow a maximum delay of 15 minutes. After this time, the instructors will leave for activities and no refund or compensation will be required.

ART. 10 – CHILDCARE (MINORS):

Unaccompanied minors:

Minors under the age of 14 who are not accompanied by an adult (legal guardian) are not accepted in group activities.

Unaccompanied minors aged 14 to 18 years old may be accepted in group activities, subject to parental permission and certain conditions (sporting level, skill, etc.)

In this case, a parental consent form will be signed by the legal representative on the day of the activity.

In the case where the activity requires a site visit (cliff, canyon, cave, etc.), the transport of the minor must be ensured by the legal representative.

Minors in the school field trip way:

The organization organizing the stay or outing must be able to provide to the instructor and to Cors’Aventure, for each participant (young and animator)

– a certificate of swimming 25 meters and the ability to dive,

– the health record of each participant.

On the other hand, Cors’Aventure undertakes to provide the certificates and documents necessary for the organization of the stay/outing (DDCSPP authorization, insurance, diplomas of the instructors, etc.)

The supervision of young minors is subject to regulations that limit it to 8 young people and 1 animator (maximum). Each group of minors must be accompanied by 2 adults, including one animator from the center and the instructor supervising the activity.

ART 11. GIFT CERTIFICATE

The gift certificate is effective upon receipt of the full amount of the service.

The order form is nominative. However, it can be transmitted to the person of your choice under condition of notifying us in advance to modify the contact details of the new beneficiary.

The beneficiary of the gift certificate must necessarily contact us to book the outing.

The activity of the gift certificate can be replaced by another activity offered by Cors’Aventure, provided that the value of the latter is less than or equal to the activity mentioned on the gift certificate. However, it is possible to carry out an activity of a higher amount by paying the difference.

WARNING: The gift certificate has an expiration date. After the validity period (current year), the service will be considered as executed and cannot be postponed. The beneficiary and/or the buyer will not be entitled to any refund or compensation.

The gift certificate and the nominative document are to be presented on the day of the outing to the instructor in charge of the session.

The outing will be guaranteed in the case where the minimum number of required participants is guaranteed and in the case where the weather conditions allow the good practice of the activity.

ART. 12 – DISPUTE RESOLUTION

The parties will endeavor to resolve amicably any difficulties that may arise in the performance of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and performance of this agreement shall be governed exclusively by the rules of French law.

All disputes, of whatever nature, shall be subject to the jurisdiction of the French civil and commercial courts, including those ruling in summary proceedings.

II. EQUIPMENT RENTAL

ART 1. BOOKING

All our activities, including equipment rental (canyoning, kayaking and water base), are by reservation. The reservation is effective from the moment the subscriber receives a confirmation email.

Article 1: The period for which the contract was concluded cannot be changed without the agreement of Cors’ Aventure and to the extent of its possibilities.

Article 2: A deposit of 30% of the rental price is payable at the time of booking. This deposit will remain acquired by the owner if a cancellation occurs less than 30 days before the rental. The tenant agrees to pay the balance of the sum no later than 8 days before taking possession of the equipment as well as a deposit when taking the equipment. If the rental is canceled by Cors’ Aventure for weather reasons, the deposit will be refunded.

Article 3: The amount of the rental will remain acquired by the owner whether or not the tenant has made use of the equipment during the rental, for whatever reason.

Article 4: In the event that, as a result of an accident during the previous rental, or any other impediment beyond its control, the owner could not give possession of the above-mentioned equipment on the agreed date, it will have the full right to make available to the tenant equivalent equipment.

Article 5: Only navigation within 5 nautical miles of the coast is authorized. The tenant agrees to embark the number of people provided for by the manufacturer. The tenant will be solely responsible to the maritime and customs services, lawsuits, fines, prosecutions and seizures incurred by himself in case of involuntary fault on his part. In the event of seizure of a rented boat, the tenant will be required to pay the owner an obligatory and contractual indemnity, corresponding to the current rental rate.

Article 6: The tenant is required to return the equipment in good working and operating condition, with all its equipment, as it was at the start. If the state of restitution is satisfactory, the deposit is returned to the tenant.

Article 7: If a deterioration, or loss, of the equipment or accessories is found, the tenant is required to pay for its repair or replacement. The refund of the deposit will be deferred until the settlement by the insurance company of the repair or replacement invoices. This refund will be made taking into account the non-refundable deductible by the insurance company and all incidental costs that would have resulted from the damage.

Article 8: The tenant is required to return the boat and equipment within the agreed deadlines.

Article 9: In the event of an accident, the tenant is required to urgently notify Cors’Aventure, requesting instructions.

Article 10: The deprivation of enjoyment resulting from accidents that occurred during this rental and not imputable to Cors’Aventure will not be subject to any refund of the rental amount, even partial.

Article 11: Subletting is strictly prohibited.

Article 12: All costs of proceedings resulting from this rental will be borne by the tenant.

Article 13: For all disputes relating to the execution of this contract, and without amicable agreements, an attribution of jurisdiction will be expressly made to the courts of Corsica.

ART. 2 – PRICE

The rental rates are displayed on the website and in the activity brochure.

The prices include the rental of technical equipment.

Below are the different rental formulas:

Canyoning shoes rental

Single or double sit-on-top rotomod sea kayak rental by the hour, half-day, day or several weeks

Single or double Prijon sea kayak rental for several days

Paddle, Fun Boat and hobitcat16 catamaran rental

The prices do not include: The possible rental of complementary equipment (e.g. Go Pro, laptop) Transportation to the activity location (meeting place and practice site) Personal expenses

ART. 3 – PAIEMENT METHODS

The payment must be made to the order of Cors’Aventure.

Payment methods accepted: check, vacation voucher, bank transfer, online payment or cash.

A security deposit of €200 is required for rotomod kayaks and a security deposit of €500 is required for Prijon kayaks. The deposit will be returned upon return of the equipment. The balance must be paid no later than 8 days before taking possession of the equipment.

The opening hours are mentioned when the equipment is returned.

ART 4. INSURANCE AND LIABILITY

In the case of sporting activity with equipment, and especially in the case of rental of sporting equipment (excluding activities supervised by an instructor), the client acknowledges that he has the knowledge and technical skills necessary to practice this sporting activity alone. The client practices in this case under full responsibility and at his own risks and perils the activity for which the said equipment is rented. The SARL Cors’Aventure will not be liable in the event of an accident that may occur during the said non-supervised activity.

The team and the SARL Cors’Aventure not having the means to verify the level of sporting practice of its clients, it is therefore up to each participant/client to have evaluated his physical condition, his knowledge and his skills in accordance with what he wishes to achieve.

ART. 5 – INSURANCE

The SARL Cors’Aventure is insured for Professional Civil Liability for its own activities and its liability cannot be engaged for any incident or accident that may occur during an unguided activity.

In addition, we strongly advise each participant to be covered by a civil liability insurance and/or an individual accident insurance with the insurance of his choice for the practice of mountain sports.

The practice of outdoor activities takes place in a specific environment called “risky”.

Each participant is aware, given the specific nature of the activities practiced, that he may run certain risks due in particular to the distance, isolation and the specific nature of the activity and the environment (river, cave, etc.). He assumes them in full knowledge of the facts and he must comply with the rules of prudence and follow the recommendations of the delegated federations (FFME) and the competent authorities (DDCSPP, municipality and prefecture).

The participant/client is responsible for the equipment that has been assigned to him. The SARL Cors’Aventure will not be liable for the damage that may be caused by this equipment. In case of theft, loss or damage to rented equipment, the participant/client will be asked for compensation related to wear and tear or a full refund of the equipment.

The SARL Cors’Aventure will not be liable for the loss, theft (including in vehicles) or breakage of objects (e.g. glasses, cameras, etc.) that the participants may take with them during the activity and that may occur during the activity.

ART. 6 – CANCELLATION / INTERRUPTION

6.1 Cancellation by the client

– A 30% deposit on the rental price is payable upon signing the rental contract.

– This deposit will remain with the owner if a cancellation occurs less than 30 days before the rental.

– The tenant agrees to pay the balance of the amount and the amount of the deposit, no later than 8 days before taking possession of the equipment.

6.2 Cancellation by Cors’Aventure

– If the rental is canceled by Cors’Aventure for weather reasons, the deposit will be refunded.
